Anytrack privacy policy

This Privacy Policy (“policy”) applies to the websites: www.anytrack.io  (the “Websites”, “Sites”) owned and operated by Anytrack Analytics Inc (collectively “AnyTrack”, “we”, “us”, “our”). This Privacy Policy describes how AnyTrack collects, uses, shares and secures the personal information you provide, as well as any personal information transferred to us for processing on behalf of our Customers (“Customer Data”). It also describes your choices regarding use, access and correction of your personal information.

By visiting one of our websites, visiting an AnyTrack Customer’s website that provides notice of its use of one of our products and/or this policy, or registering for our service, you acknowledge that you accept and consent to the practices outlined in this Privacy Policy.

EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield

AnyTrack Analytics complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. 

AnyTrack is responsible for the processing of personal data it receives, under each Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. AnyTrack complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland.

With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, AnyTrack is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, AnyTrack may be required to disclose personal data in response to lawful requests by public authorities.

In compliance with the Privacy Shield Principles, AnyTrack commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries regarding our Privacy Shield policy should first contact AnyTrack at: service@anytrack.io.

Information We Collect

Visitors to AnyTrack’s Website

If you are a visitor to one of our Websites or an AnyTrack Customer (“Customer”) who registers or signs in to one of our websites, we may collect the following information about you which may include information that can itself be used to identify and/or contact you (“Personally Identifiable Information”):

  • Contact information such as your name, email address, mailing address, phone number and time zone;
  • Billing information such as your credit card number and billing address;
  • Unique identifiers such as username, account number, order number, account name or password;
  • Information about your business such as company name, company address, company size or business type;
  • Contact information and unique identifiers for other members of your organization.
 

We also automatically collect certain information via technology:

  • As is true for most websites, when you visit our websites, some information is gathered automatically. This information may include the Operating System (OS) running on your device, Internet Protocol (IP) address, geo location based on your IP address, Internet service provider (ISP), access times, browser type and version, screen size, language, and the website you visited before our site. We also collect information about what files you viewed on our site (HTML pages, graphics, etc), what links you’ve clicked on and what page elements you’ve interacted with.
  • We automatically collect information using “cookies” or similar technologies in order to improve our website, our marketing activities and your experience. We use cookies to see which areas and features are popular, to count visits to our site, to perform A/B tests, to identify repeat visits and for other purposes such as product usability. Most Web browsers are set to accept cookies by default. If you prefer, you can choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our site and could remove cookies used for opt-out of tracking.
  • AnyTrack may also collect certain information using Web Beacons. “Web Beacons” are electronic images that may be used on AnyTrack’s Websites, in AnyTrack’s products or services, or in our email communications. They are used, for example, to count website sessions or to inform whether an email has been opened.

We may create anonymous data records from personal information by excluding Personal Identifiable Information (such as your name or email) that makes the data personally identifiable to you. We reserve the right to use anonymous data for any purpose and disclose anonymous data to third parties in our sole discretion.

Visitors to AnyTrack’s Customers’ Websites

Our Customers may use third party services (“Service(s)”) to gather information related to the activities that visitors perform while visiting their web sites (“Customer Data”). When a visitor engages with a website that uses AnyTrack’s Services, code contained on the website connects with AnyTrack’s servers and enables AnyTrack to gather Customer Data. Some Customers may also use their own code to obtain Customer Data and then pass such information to AnyTrack’s servers. Customer Data may include Personally Identifiable Information, including, but not limited to, the types of information listed above.

Customer Data is stored on AnyTrack’s web servers and databases (including those hosted on third party servers on behalf of AnyTrack) for use in performing analysis, producing reports, and providing notifications or other services for the applicable AnyTrack Customer.

AnyTrack’s tracking and analysis of Customer Data helps our Customers to understand and improve their websites, to understand and improve their marketing campaigns. AnyTrack’s Customers determine the types of Customer Data that are sent to AnyTrack’s servers for analysis. This data may include or be linked to Personally Identifiable Information depending on how the Customer uses AnyTrack’s Services on its website(s).

AnyTrack’s Terms of services prohibits from sending personally sensitive Customer Data (e.g. personal health information, political opinions, religious or philosophical beliefs) to AnyTrack and AnyTrack does not knowingly receive such data.

In addition, AnyTrack may collect certain information about a Customer’s visitor automatically, including: the Operating System (OS) running on their device, Internet Protocol (IP) address, geo location based on their IP address, Internet service provider (ISP), access times, browser type and version, screen size, language, and the website they visited before Customer’s website. How We Use the Information We Collect

Visitors to AnyTrack’s Websites

We use the information collected through our site to:

  • Improve our website, application services, and how we operate our business;
  • Create and secure your account on our platform;
  • Identify you as a user in our system;
  • Provide and deliver the products and services you request;
  • Send you related information including confirmations, invoices, technical notices, updates, security alerts, support and administrative messages;
  • Address your comments, questions and other inquiries;
  • Communicate with you about Anytrack services;
  • Protect, investigate, and identify fraudulent, unauthorized or illegal behavior.
 

Visitors to AnyTrack’s Customer’s Websites

Except as described in the “Who We Share Information With” section below, AnyTrack never sells or shares any Customer Data with individuals or companies other than the specific Customer whose website transmitted the Customer Data to AnyTrack.

AnyTrack does not link any Personally Identifiable Data across multiple, different websites that are operated by different Customers, nor does it use any Customer Data for purposes of behavioral advertising. However, AnyTrack may analyze Customer Data in the aggregate for purposes of internal research and/or to determine overall trends or metrics concerning how users are interacting with sites, and may report aggregated insights publicly, without disclosing any Customer Data.

AnyTrack contractually requires its Customers to comply with all applicable laws, rules and regulations, including the Safe Harbor and Privacy Shield where it applies, as well as other applicable laws relating to privacy and data collection (“Applicable Laws”). AnyTrack also contractually requires its Customers to obtain any necessary consents from visitors to its website(s) for the Customer’s use of AnyTrack’s services, comply with all Applicable Laws (including, as an example, the Safe Harbor and Privacy Shield where it applies) with respect to the transfer of Personally Identifiable Information of EU or Swiss subjects through the Service, and to post an online privacy policy that provides each visitor with clear notice of its practices regarding data collection, use, and disclosure (including the Customer’s use of AnyTrack’s Services), along with a link to the AnyTrack Privacy Policy and to the AnyTrack Service Opt-Out (discussed below).

AnyTrack cannot be held responsible for any Customer’s failure to make these disclosures on its website or for any Customer’s use or collection of Customer Data that is not permitted under this Privacy Policy or otherwise.

Who We Share Information With

  1. With Third Parties:

We may share your information with third-party business partners for the purpose of enhancing our products and services. We may share the names and logos of current Customers with prospective Customers, or on our website. If you do not want us to share your personal information with these companies, contact us at the contact information below.

  1. With Service Providers:

We share your information with third parties who provide services on our behalf to help with our business activities and the performance of the contract between you (The customer) and us. These companies are authorized to use your personal information only as necessary to provide specific services to us. 

These services may include:

  • Payment processing and handling
  • Providing customer support
  • Managing referral programs
  • Product research and analysis
  • Providing cloud computer infrastructure
  • Sending marketing communications
 
These third parties are all compliant with the Privacy Shield Principles.
 
  1. Public Authorities:

In given situations, AnyTrack may have to disclose personal data in response to lawful requests by public authorities, or law enforcement requirements. We may also disclose your personal information as required by law, such as to comply with legal process, when we believe in good faith that disclosure is necessary to protect our rights, when we believe there is a violation to our Terms of Service, to protect your safety or the safety of others, to investigate fraud, or respond to a government request.

Security

We follow generally accepted security and encryption standards to protect the personal information submitted to us. We restrict access to personal information to AnyTrack employees, contractors and agents who need access to that information in order to perform their duties. These individuals and/or entities are contractually bound by confidentiality obligations and may be subject to termination and criminal prosecution, if they infringe  these obligations.

We may have to retain your information for as long as your AnyTrack account is active or as needed to provide you services, comply with our legal obligations, resolve disputes and enforce our agreements.

Access

Upon request AnyTrack will provide you with information about whether we hold any of your personal information. You may access, correct, or request deletion of your personal information by contacting us at the contact information below. We will respond to your request within a reasonable timeframe. In certain circumstances we may be required by law to retain your personal information, or may need to retain your personal information in order to continue providing our service.

With respect to the analytics platform AnyTrack provides to Customers, AnyTrack acknowledges that you have the right to access your personal information. AnyTrack has no direct relationship with the individuals whose personal information it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his or her query to the AnyTrack’s Customer (the data controller). If requested to remove data we will respond within a reasonable timeframe.

Choice

We partner with third parties to manage our advertising on other sites. Our third party partners may use cookies or similar technologies in order to provide you advertising based upon your browsing activities and interests. We may contact you by email if you access AnyTrack products or services. By registering or using AnyTrack Services, you specifically consent to the receipt of these communications. You can unsubscribe at any time to any of our email regarding updates or products by following the unsubscribe instructions of any message. Note that communications related to security, billing or any other matter that requires your immediate attention will still be sent.

Our Policy Toward Children

Our Sites and Services are not directed to children under 13. We do not knowingly collect personally identifiable information from children under 13 or from websites that are targeted to children under 13. Any information related to children under the age of 13, personal or not is found on our servers, it will be immediately deleted.

Changes to This Privacy Policy

We update this Privacy Policy to reflect changes to our data collection, processing and storage practices. If we make any material changes we will notify you by email and through on-site notifications.
